TDA 2.2 Safeguarding the welfare of children and young people 1.1
When working with children and young people there are many legislations, guidelines and policies in place that ‘safeguard’ them including E-safety. These acts are constantly evolving and amended to improve the lives and safety of every child. The United Nations convention on the rights of rights of the child (UNCRC), (1989) although not legislation provides a full list of comprehensive rights ALL children should expect. These rights include
•special protection measures and assistance
•access to services such as education and healthcare
•develop their personalities, abilities and talents to the fullest potential •grow up in an environment of happiness, love and understanding •be informed about and participate in achieving their rights in an accessible and active manner.
Mission is to advocate for protection of children’s rights, to help meet their opportunities to reach their full potential. UNICEF is guided in doing this by the provision and principles of the Convention on the Right of the Child. Article 2: non-discrimination; every child has the right to a life free from discrimination Article 3: best interests; right should be applied in the best interest of the child Article 6: life, survival; children have the right to survive and develop to the fullest Article 11: special protection; children have the right to protection from abduction Article 13: respect of the views; children have the right to express themselves.
The Children’s Act 1989 (England and Wales) + Children (Northern Ireland) Order 1995 This Act has many concepts, these are parental responsibility, the welfare of the child and partnership and cooperation from other services. This act states the mental and physical well-being of the child of the child is above all else and appropriate steps are taken to ensure this. This act has two very important sections which are focus primarily on child protection. Section 17 states that local authorities must put into place the services to safeguard and also the services must promote the welfare of children and young people within their area who are in need. The other section is section 47 which states that local authorities have the duty to look further into a situation, when they have reasonable cause or suspect that a child or young person who is either living or found in their area has suffered from or is suffering from significant harm.
Education Act 2002
This sets out the responsibilities of all those who are working in schools or with children and young people. The governing bodies, the headteacher and local education authorities (LEA’s) to all work together to ensure that all children are safe and free from harm.
Children’s Act (2004)
This Act was updated as it showed services for children were not working together to protect vulnerable children as in the Victoria Climbie case, who tragically died at the hands of her carers. The inquiry report revealed major failings within the different child protection systems and procedures with which the eight year old girl came to contact. Victoria Climbie died despite being know to four London boroughs, two hospital, two police child protection teams and the national society for the Prevention of Cruelty to Children. An Eight year old girl, brought to England for a better life, died after suffering serious cruelty and neglect. Anna Victoria Climbie was beaten, burned with cigarettes and force to sleep in a bin liner inside an empty bath. She died in hospital in February 2000, suffering from hypothermia and malnutrition. .
