The key aspects to legislation relevant to the roles and responsibilities of a teacher are: Data Protection Act
This act was designed to protect information that is obtained by companies or individuals from being passed on to other persons without authority. Under the Data Protection Act personal date is defined as:
Data that relate to a living individual who can be identified from that information, or from data and other information in the possession of the data controller or which are likely to come into his or her possession. These include any expression of opinion about the individual and of the intentions of the data controller in respect of that individual. The Act contains key principles such as;
Personal data shall be processed fairly and lawfully.
Personal data processed for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes. Personal data shall be processed in accordance with the rights of data subjects under the Act. Appropriate technical and organizational measures shall be taken against unauthorized or unlawful processing of personal data and against accidental loss or destruction of, or damage to, personal data. It is advisable that you make yourself aware of the Data Protection act which can be accessed by going on to www.ico.gov.uk/dataprotection.
